Please read these Website Terms and Conditions carefully before using Woyono.

01Scope and parties

1.1 These Terms form a legally binding agreement between you and Woyono Limited ("Woyono", "we", "us") each time you access or use the Woyono website, including the public marketing pages, help centre, browser-based account portal, web forms and browser-based demonstrations (together, the "Website").

1.2 The installed video game, mobile application and desktop application each have their own product terms. Where a browser-based feature replicates functionality governed by those product terms, the product terms prevail for that feature.

1.3 Additional terms — such as organisation programme terms, competition rules or subscription terms — may apply alongside these Terms. If there is a direct conflict, those additional terms take priority to the extent of the conflict.

1.4 Nothing in these Terms excludes or limits mandatory consumer rights or data protection rights that cannot lawfully be excluded.

02Eligibility and accounts

2.1 The standard consumer service is intended for people aged 16 or over. Users under 18 receive much more privacy and safety defaults.

2.2 Woyono does not request or require a legal name for a standard account. Accounts use non-name identifiers — for example an email address, username, screenname, Woyono user ID, organisation or programme ID, or platform-specific identifier.

2.3 You must:

  1. provide accurate account information (excluding legal name, which is not required);
  2. keep your credentials confidential;
  3. report unauthorised access promptly to support@woyono.com; and
  4. not permit another person to complete a scored activity on your behalf.

03AI interviews, scores and limitations

3.1 Woyono may generate or adapt questions, transcribe speech, evaluate responses against role-relevant rubrics and generate developmental feedback using artificial intelligence.

3.2 AI output may be incomplete or affected by accent, disability, background noise, language variety, device quality, network conditions or limited context. You should treat scores and feedback as developmental guidance, not as definitive assessment.

3.3 Scores, rankings and skill indicators do not guarantee employment, admission, promotion, income, qualification or real-world competency.

3.4 Woyono does not analyse voice tone, facial expression or biometric signals to infer emotion, honesty, personality or mental state.

04Microphone, voice and recording

4.1 Microphone input may be processed to create a text transcript. Raw audio is not retained by default.

4.2 Where an optional audio or video recording feature is available, Woyono will provide a prominent pre-capture notice that states the purpose, intended recipients, retention period and lawful basis before recording begins. A visible indicator will remain on-screen throughout.

4.3 An optional encrypted acoustic profile may be offered to improve speech recognition in noisy environments. If enabled, that profile:

  1. must not be used for general identity matching, emotion recognition or advertising; and
  2. can be deleted independently at any time via your account settings.

05User content and prohibited submissions

Licence

5.1 You retain ownership of the permitted content you submit. You grant Woyono a non-exclusive, royalty-free, worldwide licence to host, process, display and technically adapt that content solely to provide, secure, support and improve the services described at the point of submission.

5.2 Woyono will not use identifiable interview content to train a general-purpose AI model without a separate, informed and voluntary opt-in.

Prohibited submissions

5.3 Do not submit:

  1. your legal name or a government-issued identity document (neither is required for standard account creation, interviews, gameplay or app use);
  2. confidential employer, examination, patient, student, financial or other sensitive identity information — unless a separately assessed feature explicitly requests the minimum necessary data and you are authorised to provide it.

06Acceptable use

6.1 You must not:

  1. attack, probe, overload, scrape, bypass or reverse-engineer protected components of the Website, or introduce malware;
  2. use bots, scripts, pre-recorded responses, voice cloning, deepfakes, account sharing or unauthorised AI assistance to misrepresent your performance;
  3. upload or transmit content that is unlawful, abusive, discriminatory, deceptive, infringing or privacy-invasive; or
  4. use the Website for covert surveillance, prohibited profiling, or to make or support unlawful automated decisions about individuals.

07Organisation programmes

7.1 An employer, school, college, university, training provider, government body or other organisation (a "Partner") may assign activities to you and receive disclosed results through a programme.

7.2 The programme notice or data-processing agreement between Woyono and the Partner will set out the data-protection roles (controller, processor or joint controller) for each processing purpose. Details relevant to you as a data subject are in the Privacy Policy.

7.3 Under the standard configuration, a Partner must not use a Woyono score as the sole basis for an employment, admission, promotion, discipline, certification or other significant decision about an individual.

08Purchases, subscriptions and rewards

8.1 Prices (inclusive of applicable taxes), billing periods, auto-renewal terms, cancellation and refund information will be displayed before you commit to a purchase.

8.2 Where purchases are made through a platform store (e.g. Apple App Store, Google Play), the store operator's payment and refund terms also apply.

8.3 Mandatory consumer cancellation and refund rights — including any applicable cooling-off period — are not affected.

09Intellectual property

9.1 Woyono and its licensors own all rights in the software, game world, artwork, user-interface design, trademarks, question banks, scoring logic, prompts, documentation and other protected materials, excluding your User Content.

9.2 These Terms grant you a limited, non-exclusive, revocable, non-transferable licence to use the Website for its intended purpose. No other intellectual property rights are transferred or implied.

11Availability, updates and changes

11.1 Features may change for reasons of security, accessibility, balancing, maintenance, legal compliance, operating-system compatibility or product development. Woyono does not guarantee uninterrupted or error-free access.

11.2 Material reductions to a paid service during an active subscription period will be handled in accordance with applicable consumer law and the relevant subscription terms.

12Suspension, termination and appeals

12.1 Woyono may restrict or suspend your access if there is a serious or repeated breach, fraud, cheating, safeguarding concern, security risk or non-payment.

12.2 Where reasonably practicable, Woyono will give reasons for any restriction or suspension and offer an appeal route. Automated integrity flags are indicators, not conclusive proof of a breach.

13Disclaimers and limitation of liability

Nature of the service

13.1 Woyono is a learning and simulation service. It is not a substitute for complete workplace training, or for professional career, financial, legal, medical or mental-health advice. Website demonstrations, career content and AI-generated examples are general information and may not reflect every employer, jurisdiction or individual circumstance.

Limitation of liability

13.2 To the maximum extent permitted by law, Woyono's total aggregate liability to you under or in connection with these Terms — whether in contract, tort (including negligence), breach of statutory duty or otherwise — shall not exceed the greater of (a) the amounts you have paid to Woyono in the 12 months preceding the claim, or (b) £100.

13.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

13.4 Liability between Woyono and an organisation Partner is governed by the signed enterprise agreement.

14Privacy

14.1 Woyono's collection and use of personal data is described in the Privacy Policy and, where applicable, the Cookie Policy. Those documents form part of the basis on which you use the Website.

15.4 UK data-protection complaints will be acknowledged within 30 calendar days and investigated without undue delay. If you are unsatisfied with the outcome, you may refer the matter to the Information Commissioner's Office (ICO).

16Governing law and disputes

16.1 These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction.

16.2 If you are a consumer habitually resident in another part of the United Kingdom, an EEA member state or Nigeria, you retain any mandatory local consumer protections and the right to bring proceedings in your local courts.

16.3 Organisation customers are governed by the law and jurisdiction specified in their signed agreement.

17Changes to these Terms

17.1 Woyono may update these Terms from time to time. Material changes will be notified through the Website, your account dashboard or the email address associated with your account, with reasonable advance notice.

17.2 If you do not agree with a material change, you may close your account before the change takes effect. Continued use of the Website after the effective date constitutes acceptance.

18General

18.1 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

18.2 Waiver. A failure or delay by Woyono in exercising any right under these Terms does not waive that right.

18.3 Entire agreement. These Terms (together with any additional terms referenced in clause 1.3) constitute the entire agreement between you and Woyono in relation to the Website, and supersede all prior understandings.

18.4 Assignment. Woyono may assign its rights and obligations under these Terms to an affiliate or successor. You may not assign your rights without Woyono's prior written consent.

18.5 Third-party rights. No person other than you and Woyono has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
